Les différentes crises inédites que traverse le monde et les récentes admissions de l’imprévision dans les pays qui partagent les mêmes traditions juridiques avec les États membres de l’Organisation pour l’harmonisation en Afrique du droit des affaires (OHADA) invitent à repenser le traitement de l’imprévision dans cet espace. Dans la plupart des pays membres de l’OHADA, le législateur est resté muet sur l’admission de l’imprévision. La doctrine prêche beaucoup sur la question, et fort heureusement la pratique, elle, ne s’embarrasse pas de scrupules pour proposer des mécanismes liés à l’imprévision dans les contrats. La jurisprudence dans ces États ne s’est aucunement engagée sur la voie de la reconnaissance de cette théorie pourtant favorable à la justice contractuelle. De ces constatations, il a été proposé à la suite de l’abandon de l’avant-projet d’Acte uniforme OHADA sur le droit des contrats (projet Fontaine), un projet portant harmonisation du droit des obligations qui prend en compte l’imprévision dans l’espace OHADA. À travers cet article, l’auteur invite à relire les conditions de mise en oeuvre de l’adaptation conventionnelle et judiciaire du contrat pour imprévision dans ce projet à l’aune des pratiques contractuelles africaines.
