Abstract
La Cour africaine des droits de l’homme et des peuples (Cour ADHP), bien qu’elle n’ait pas été conçue comme une juridiction spécialisée en droit international humanitaire (DIH), dispose d’une compétence formelle lui permettant d’interpréter et, dans certaines circonstances, d’appliquer ce corpus juridique. Pourtant, cette compétence reste faiblement exercée dans la pratique, et le DIH demeure largement absent de sa jurisprudence. L’auteur propose une analyse approfondie de cette situation, en identifiant les fondements juridiques de la compétence de la Cour ADHP pour mobiliser, voire appliquer le DIH, les conditions concrètes d’exercice de cette compétence, ainsi que les raisons structurelles, politiques et institutionnelles qui en freinent l’activation. Il explore également les perspectives de renforcement de l’intégration du DIH dans le contentieux régional africain des droits humains, en insistant sur la complémentarité normative entre les deux régimes. Enfin, il examine le potentiel que recèle la future Cour africaine de justice et des droits de l’homme et des peuples pour renforcer l’application du DIH à l’échelle régionale, en particulier par l’entremise de sa section de droit général et de sa section pénale.
