Issu d’une thèse de doctorat, l’ouvrage de Dave Guénette s’intéresse à la manière dont les constitutions sont modifiées dans les sociétés fragmentées. Il constitue à nos yeux un apport précieux à la science constitutionnelle, au moins à deux titres. Le premier, c’est de participer au renouvellement de la théorie du fédéralisme à travers son application à des contextes marqués par des clivages notamment linguistiques. Ces clivages ne traversent pas les sociétés américaine ou allemande, dont les institutions servent traditionnellement de modèle à cette théorie. Le deuxième intérêt de l’ouvrage est d’ordre doctrinal. On y trouvera la description rigoureuse des règles relatives à la révision constitutionnelle en Belgique, au Canada et en Suisse, en évitant les écueils comparatistes de la superficialité ou du manque de référencement à la littérature produite par des chercheurs « locaux ». Le propos ne se limite pas aux quelques articles que les constitutions consacrent à cette fonction, mais embrasse un ensemble plus large de traits institutionnels et de données historico-politiques qui l’influencent. La description présente aussi pour vertu d’informer le lecteur d’une série de spécificités procédurales : pensons au droit de retrait ou au droit d’initiative provincial que l’on retrouve tous deux dans le droit constitutionnel canadien, aux groupes linguistiques en Belgique ou à la garantie fédérale des constitutions cantonales suisses.
