Début décembre 2019, une pneumonie d’origine inconnue a été détectée dans la ville de Wuhan, en Chine. Le 30 janvier 2020, l’OMS a déclaré que la maladie dénommée Covid-19 causée par le coronavirus constituait une urgence de santé publique de portée internationale, car des cas avaient alors été signalés dans toutes les régions de la planète en l’espace d’un mois seulement. Elle s’est ensuite propagée à grande vitesse, provoquant une crise sanitaire sans précédent au point d’entraîner le quasi-effondrement de la grande majorité des systèmes de santé publique dans le monde. Ses conséquences, d’abord sanitaires, mais aussi sociales et économiques, ont parfois été dévastatrices. Dans ce contexte, il semble évident que les conséquences d’une crise sanitaire d’une telle ampleur ont également un impact sur le domaine juridique, d’où l’intérêt d’étudier la responsabilité civile sous l’angle des crises sanitaires qui, comme la Covid-19, ont marqué un tournant dans la gestion de la santé publique à travers le monde. L’ouvrage ici présenté est issu d’un séminaire du Groupe de recherche européen sur la responsabilité civile et l’assurance (GRERCA) qui s’est tenu en avril 2023 à l’Université de Saint-Jacques de Compostelle et qui a été organisé par l’ équipe de recherche GI-1147 De Conflictu Legum en coopération avec l’Université Pontifi cale Comillas de Madrid. Il a été rédigé par des spécialistes du droit de la responsabilité civile des différents droits européens (allemand, anglais, belge, espagnol, français, italien, portugais, suisse, tchèque), mais également d’Amérique du Nord (québécois) et complété par des rapports de synthèse qui systématisent les rapports nationaux sur les différents thèmes abordés dans cet ouvrage dans le but de trouver les solutions les plus satisfaisantes. L’ouvrage s’adresse à tous les universitaires (enseignants, chercheurs et étudiants de dernier cycle) et praticiens intéressés en droit de la responsabilité civile, mais aussi au législateur, qui pourra y trouver des sources d’inspiration pour faire face aux crises à venir.
