Abstract
Este artigo pretende fomentar uma reflexão, sem fixações predeterminadas de práticas oficiais voltadas para a interpretação legal tributária de interesse da administração fazendária, sobre a fundamentação das decisões administrativas, notadamente fiscais, no âmbito federal que, doutrinariamente, são consideradas inseridas na definição da motivação do ato administrativo em geral, existentes dentro do competente processo administrativo tributário.Parte-se da premissa de que o termo "fundamentação", aqui adotado, diz respeito ao plano de significação, como "percurso gerador de sentido" na construção da norma jurídica, pelos ensinamentos do prof.Paulo de Barros Carvalho.A presente abordagem tem o escopo de, como fruto de observação sobre as decisões colegiadas proferidas nos julgamentos administrativos perante o Primeiro Conselho de Contribuintes, se aprofundar na análise da interpretação jurídica praticada nos órgãos colegiados administrativos fiscais, seja da primeira instância administrativa (DRJs da SRFB), seja perante a emanada dos Conselhos de Contribuintes/MF, atualmente Conselho Administrativo de Recursos Fiscais (CARF).Parte-se da problematização do tema, qual seja, da experiência pragmática, de que as decisões administrativas, na sua maioria, quando caminham no exercício da busca de melhor
