Est‑il possible de déléguer la totalité de la fonction juridictionnelle aux machines? Pour certains, cette hypothèse doit être regardée comme un nouveau mythe. Pour d’autres, en revanche, cette délégation est inéluctable, en raison de la contribution croissante des machines dites « intelligentes » à l’administration de la justice. Cette controverse, qui n’est pas nouvelle, reçoit une résonance singulière à l’heure où les projets de création de juges‑robots, aux côtés des juges‑humains, fleurissent. L’un des enjeux de cette création est d’améliorer l’accès à la justice. Partant, le remplacement éventuel des juges‑humains par des machines dans tous les contentieux serait problématique en raison des atteintes aux droits fondamentaux et, surtout, à cause du caractère inadapté de la justice robotisée aux contentieux qui impliquent des personnes d’une particulière vulnérabilité (enfants, communautés autochtones, femmes victimes de violences conjugales, etc.). Il est donc urgent de trouver un équilibre entre la protection effective de ces droits, la promotion de l’innovation des technologies numériques et la nécessité d’améliorer l’accès à la justice au moyen de ces technologies. C’est cette idée qui constitue l’épine dorsale de cette étude qui, dans une approche prospectiviste, démontre que pour des raisons d’ordres culturel, juridique et philosophique, la substitution totale du juge‑humain au juge‑robot n’est ni souhaitable ni possible. D’ailleurs, la pratique des États, la pratique juridictionnelle et les réformes institutionnelles en cours écartent à bien des égards l’hypothèse de la substitution totale en faveur de la substitution partielle; ce qui induit une complémentarité entre les deux catégories de juges .
