Abstract
Pouvoirs et souveraineté sont deux concepts distincts liés à l’autorité et à la puissance d’un État. Si dans les États fédéraux, ceux-ci sont théoriquement partagés entre plusieurs niveaux d’autorité, la souveraineté peut être comprise comme un concept global inscrit dans la charte fédérale, tandis que les pouvoirs sont répartis entre les différentes unités. Ce cadre constitutionnel soutient la stabilité et la fonctionnalité des États fédéraux. Des crises intergouvernementales peuvent toutefois survenir à cause de trois facteurs : l’incertitude constitutionnelle, la distribution asymétrique des compétences, ou des conceptions différentes de la souveraineté. Cet article vise à analyser ce dernier facteur, qui est directement lié aux deux premiers, afin de contribuer à mieux comprendre les différences de visions sur la répartition constitutionnelle du pouvoir dans les régimes fédéraux stables. Cet article examine les représentations politiques liées à la souveraineté, le pouvoir et la compétence au Québec et au Texas depuis les années 1960, s’appuyant principalement sur des archives.
