Que ce soit en France, au Québec ou dans la plupart des pays de tradition civiliste, lorsqu'il est question de protéger une personne majeure qui rencontre des difficultés pour administrer ses biens ou prendre soin d'elle-même, on s'en remet généralement au droit des majeurs protégés. Pour guider la mise en œuvre des régimes de protection, garantir l'autonomie et préserver la capacité juridique de la personne, des principes directeurs ont été édictés , en France et au Québec. Parmi ces principes, le triptyque "nécessité, subsidiarité et proportionnalité" est central. Leur signification est-elle la même des deux côtés de l'Atlantique? Et quelle est désormais leur place à l'aune de la Convention relative aux droits des personnes handicapées?
