Abstract

La notion de découvrabilité occupe désormais une place importante dans l’écosystème culturel, en raison notamment des préoccupations croissantes liées à l’impact des technologies numériques sur la diversité des expressions culturelles. Soutenues par des études et des actions gouvernementales, plusieurs initiatives ont ainsi émergé pour améliorer l’accès et la mise en valeur des contenus culturels en ligne. Bien que plusieurs projets aient porté une attention particulière aux aspects juridiques de la découvrabilité, aucun ne s’est consacré à l’identification systématique des instruments législatifs intégrant cette notion. Cet article vise à combler ce vide en examinant la place du concept de découvrabilité dans le droit international, européen, français, canadien et québécois. L’analyse repose sur une définition communément acceptée en France et au Québec, qui associe la découvrabilité à la disponibilité et à l’accessibilité des contenus culturels en ligne, y compris pour un public qui ne les recherche pas activement. L’étude postule que les instruments juridiques appartenant au champ des politiques culturelles ne sont pas les seuls à garantir la découvrabilité; les instruments régulant les technologies numériques et l’intelligence artificielle, ainsi que certains textes relatifs aux droits humains peuvent aussi y contribuer. L’analyse se structure en deux parties : d’une part, les instruments mentionnant explicitement ou implicitement la découvrabilité; d’autre part, ceux qui y participent en promouvant des valeurs ou principes fondateurs. L’article conclut que la découvrabilité est un enjeu de droits humains et esquisse des pistes d’action en vue d’assurer la pleine reconnaissance du lien intrinsèque entre la découvrabilité des expressions culturelles locales et les valeurs et principes identifiés.
