Este artículo analiza la doctrina del Tribunal Supremo de Canadá en su Dictamen sobre la secesión de Quebec, como referente en el tratamiento democrático de los conflictos territoriales. A pesar de lo que sugieren ciertas lecturas secesionistas, el referéndum no ocupa el centro del modelo canadiense, representando solo un estadio más en un procedimiento de toma de decisiones cuya complejidad es lo determinante y en el que el parlamento parece llamado a desempeñar el papel fundamental. A partir de un examen detallado de los textos que articulan esta doctrina, se evalúa el lugar conferido al parlamento y sus implicaciones para la articulación de la democracia constitucional. El artículo se organiza en dos secciones: una primera dedicada al análisis del referéndum como mecanismo de resolución de conflictos territoriales, y una segunda centrada en el rol del parlamento en el equilibrio democrático. Se concluye que la legitimidad de decisiones profundamente divisivas está relacionada con los costes inherentes al procedimiento mediante el cual se adoptan, y que esta doctrina sugiere la necesidad de matizar la ficción liberal de un único pueblo con una voluntad general, abriendo paso a una concepción más compleja de la democracia que combine mayorías con mecanismos de consenso.
