Abstract
Sabor Republike Hrvatske na sjednici koja je održana 28. rujna 2001. donio je Zakon o arbitraži (Narodne Novine, 88/2001), čijim je usvajanjem po prvi je puta u Republici Hrvatskoj na cjelovit način kodificirana materija koja se odnosi na arbitražno sudovanje. Tim je zakonom ugovor o arbitraži definiran kao kao ugovor kojim stranke podvrgavaju arbitraži sve ili određene sporove koji su među njima nastali ili bi mogli nastati iz određenog pravnog odnosa, ugovornog ili izvanugovornog, a može se sklopiti u obliku arbitražne klauzule u nekom ugovoru ili u obliku posebnog ugovora. Iako se arbitraža u pretežitom dijelu temelji na načelu dispozitivnosti, zakonodavac ipak određuje nužan sadržaj ugovora o arbitraži - postojanje sporazuma o podvrgavanju spora iz određenog odnosa arbitraži. Drugi conditio sina qua non jest da ugovor o arbitraži mora biti sklopljen u pisanom obliku. Izuzetak od navedenog pravila predstavljaju tzv. omekšana pravila kojima se višestruko olakšava sklapanje ugovora o arbitraži te se uvažavaju potrebe suvremenog društva i običaja u prometu. Slična rješenja sadrži i većina međunarodnih konvencija, poput Newyorške konvencije o priznanju i ovrsi stranih arbitražnih pravorijeka i Europske konvencije o međunarodnoj trgovačkoj arbitraži. Kako bi se zaštitili potrošači kao slabije ugovorne strane, posebna ograničenja propisuju se za potrošačke ugovore: kod spora koji je nastao ili bi mogao nastati iz potrošačkog ugovora ugovor o arbitraži mora biti napisan u posebnoj ispravi koju su potpisale obje strane. U toj ispravi ne smije biti drugih utanačenja osim onih koja se odnose na arbitražni ugovor, s iznimkom ako je sastavljena kod javnog bilježnika.
