Abstract
Završni rad bavi se institutom općeg pravila protiv izbjegavanja poreza (GAAR) u kontekstu europskog poreznog prava, s posebnim osvrtom na njegovu pravnu osnovu, svrhu te primjenu u sudskoj praksi Europske unije. GAAR pravila usmjerena su na onemogućavanje poreznih pogodnosti koje proizlaze iz umjetnih ili neautentičnih aranžmana čija je pretežita svrha izbjegavanje poreza. Analizira se zakonodavni okvir kroz Zakon o porezu na dobit te Preporuku Europske komisije iz 2012. godine, pri čemu se ističe manjkavost domaćih normi u odnosu na europske smjernice, osobito u pogledu preciznijeg definiranja pojmova kao što su "neautentičnost", "aranžman" i "namjera zakonodavca". Posebna pažnja posvećena je razlici između objektivnih i subjektivnih elemenata GAAR-a te pravnoj nesigurnosti koju izaziva nejasna granica između zakonitog poreznog planiranja i zlouporabe prava. U tom kontekstu razmatrani su i ključni slučajevi sudske prakse Suda EU, poput Halifax i Cadbury Schweppes koji su oblikovali pravne standarde u vezi s poreznom zlouporabom. Rad kroz te primjere pokazuje kako se kroz GAAR pokušava postići ravnoteža između prava poreznih obveznika na porezno planiranje i interesa države da zaštiti poreznu osnovicu. Završni dio rada donosi kritički osvrt na hrvatski pravni okvir, ukazujući na potrebu njegove dodatne normativne razrade i usklađivanja s europskom praksom kako bi se postigla pravna sigurnost i efikasnost u suzbijanju poreznih zlouporaba.
