Abstract
Kupoprodaja je od svojih prvobitnih oblika (trampa, mancipacija) do danas, doživjela značajnu evoluciju. Usporedni prikaz ovog ugovora, koji svoje ishodište ima u rimskom pravu, s uređenjem prema važećem Zakonu o obveznim odnosima, može se zaključiti da temeljne odrednice toga ugovora od njegovog nastanka pa do danas, u svojoj biti nisu promijenjene. Njegovi glavni sastojci su i dalje predmet i cijena, te većina pravila koja uređuju cijenu slijede upravo rješenja iz rimskog prava. Glavna pravila koja su uređivala institut cijene u rimskom pravu, određuju da ona mora biti izražena u novcu, određena ili odrediva i ozbiljno mišljena. Cijena u početku nije morala biti pravična, no kasnije, ona mora iznositi barem pola vrijednosti kupljene stvari, odnosno mora biti pravedna. U suvremenom pravu, uz preuzeta pravila iz rimskog prava, vrijedi i pravilo da ona ne smije biti protivna zakonu, odnosno stranačka autonomija će u nekim slučajevima biti ograničena zakonom. Glavna obveza kupca je isplata cijene, a strane mogu dogovoriti vrijeme, mjesto i način isplate. Institut cijene mijenja se u skladu s društvenim i ekonomskim promjenama poput krize ili inflacije, pa posljedično raste i svakodnevno utječe na naš život jer se sa cijenom zapravo, susrećemo svakodnevno u životu, na primjer već prilikom kupnje osnovnih životnih namirnica, te odlučujemo hoćemo li s obzirom na nju kupiti stvar, odnosno sklopiti kupoprodajni ugovor.
