Abstract
Cilj ovog diplomskog rada je prikazati obilježja i formu sklapanja braka u Republici Hrvatskoj od 1946. do 1998. godine. Na početku je opisana povijest i promjene u hrvatskom obiteljskom pravu do Drugog svjetskog rata. Naglasak je stavljen na 1946. godinu kada je, donošenjem Ustava Federativne Narodne Republike Jugoslavije, a nakon toga i Osnovnog zakona o braku, propisan obvezni građanski oblik sklapanja. Time je bračno pravo postalo jedinstveno uređeno za cijelu državu. Veliku prekretnicu za bračno prava predstavlja1990. godina kada je Ustavni sud donio odluku o stavljanju izvan snage članka kojim je propisana obvezna građanska forma zasnivanja braka. Obiteljskim zakonom iz 1998. bračnim partnerima dana je mogućnost izbora između vjerskog i građanskog braka. Konačno, u ovom radu ćemo vidjeti promjene u hrvatskom zakonodavstvu nakon potpisivanja ugovora sa Svetom Stolicom i brojnim vjerskim zajednicama te put prema suvremenom obiteljskom pravu.
