Abstract
Como primera medida se indagó por el significado de la inactividad y, según la Real Academia Española corresponde a la carencia de actividad, así mismo se relaciona en este caso con la pasividad de la administración pública, cuando su principal función es velar por la efectiva materialización de las funciones otorgadas a los funcionarios, respetando el goce efectivo de los derechos fundamentales de los ciudadanos. Por lo tanto, se vio la necesidad de realizar un análisis crítico de los compromisos suscritos por la Secretaría de Educación Departamental frente a los fallos de los jueces constitucionales, evaluar su efectivo acatamiento, o en el evento adverso, si se evadió la responsabilidad, dando lugar a apertura de incidentes de desacato; se der ese el caso, indagar por las razones con las cuales fundamentan el no acatamiento de los mismos. En el transcurso de la práctica que se llevó a cabo en la Secretaría de Educación Departamental se evaluaron las acciones de tutela e incidentes de desacato que se relacionen con el último trimestre del año 2017. Finalmente, se realizará una serie de propuestas que permitan mejorar el funcionamiento de la Secretaría en cuanto al acatamiento de los fallos de los jueces constitucionales y la imposición de sanciones. Ostensiblemente, el derecho a la administración de justicia no cesa en la medida en que se adopte una decisión judicial de fondo en la que se protejan los derechos de las partes, sino que éste derecho se prolonga hasta el cumplimiento efectivo de las decisiones judiciales; es decir, hasta que se materialice la protección de los derechos fundamentales involucrados, ya sea porque cese la vulneración de los mismos o simplemente porque cese la amenaza.
