У статті досліджено кримінальну відповідальність за законодавством Канади за залишення в небезпеці (стаття 215 Кримінального кодексу Канади), тобто невиконання обов’язків турботи з боку визначених осіб (батьки, прийомні батьки до досягнення дитиною 16-річного віку, опікуни, подружжя тощо), якщо потерпілий через малолітство, старість, хворобу або через інший безпорадний стан не здатен забезпечити собі повноцінне безпечне життя. Також приділена увага висвітленню складу кримінального правопорушення, а також покаранню за його вчинення. На основі проведеного аналізу запропоновано доповнити частину 1 статті 135 Кримінального кодексу України не тільки небезпечним для життя, але й для здоров’я станом, що матиме позитивний вплив для запобігання та протидії вчиненню кримінальних правопорушень проти життя і здоров’я особи, зокрема й пов’язаних із залишенням в небезпеці.
