Abstract
1 Regulation (EC) No. 261/2004 in Decision Practice of The Municipal Court in Prague Abstract This diploma thesis focuses on Regulation (EC) No. 261/2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and in particular on its application in the decision-making practice of the Municipal Court in Prague, which is the court of appeal in a significant number of court proceedings in the Czech Republic based on this legislation. The thesis is divided into 3 chapters. The first chapter contains a brief introduction to the factual and historical background of aviation law, under which Regulation (EC) No. 261/2004 systematically falls. In particular, this chapter introduces the legislation that preceded the adoption of today's legislation. Not only is Regulation (EC) No 261/2004 not the first existing legislation in the field of aviation law, but it is also not the first legislation relating specifically to air passenger rights. Among the specific legislation, two international treaties are mentioned, namely the so-called Warsaw Convention of 1929 and the so-called Montreal Convention of 1999.
