「なんぴとも生命、自由、身体の安全の権利を有し、principles of fundamental justice(PFJ)によらなければこれらの権利を奪われない」とするカナダ憲章(一九八二年憲法)七条は、その開放的な規定の性格もあって、憲法が掲げる人権のカタログ以外の人権保障を取り込む肥沃な土壌となり、この憲法で人権に関する違憲審査権を手中にしたカナダ最高裁判所によって、明文の規定のない人権を、とりわけ刑事法の領域で、積極的に保障するようになっている。もっとも、七条はPFJの留保をおき、同条前段の権利が侵害されてもPFJに反していなければ違憲とならない。いきおい、七条はこのPFJの意義が解釈の中心となる。本稿は主要な判例を分析して、カナダ最高裁判所が七条の意味を深化させているとともに、PFJの規準を明確にさせていくのを確認する。PFJは恣意性、広汎性、著しい反比例性のテストとして確立しており、包括的基本権規定となる七条にあって、人格的自律にかかわる権利を具体化するというよりも、七条前段の権利を漠然とでも侵害する立法に対して、それが個人を公正に処遇すべしとする立憲主義原理に耐えられる実体を備えているかをチェックする機能を発揮させる規範となっているのをみる。
