Abstract
L’émergence de prestations funéraires employant une intelligence artificielle aux fins d’offrir aux proches une interaction avec une reproduction artificielle de la personne prédécédée interroge sur l’état de la technique de personnification juridique en droit français. Offrant l’occasion de renouveler la question du lien entretenu entre l’opération abstraite du droit et la réalité que l’on entend, par cela, appréhender, le cas de l’avatar numérique interpelle le juriste rompu à l’idée que la personne juridique constitue une fiction utile à l’accomplissement du droit. Après avoir assisté aux dérives de la personnification morale (Freyria, 1991), faut-il s’attendre à observer le glissement de la personne physique au-delà de la vie humaine ? La présente contribution entend poursuivre l’hypothèse à propos de ce cas extrême (Thomas, 2005) en quoi consiste l’avatar numérique, en interrogeant, à cette fin, la crédibilité juridique d’une immortalité de la personne à l’aune des techniques du droit français.
