Abstract
Cette thèse explore l'état de la démocratie environnementale au Québec et en Colombie- Britannique en analysant la façon dont s'articulent les droits procéduraux environnementaux dans les deux provinces. Ces droits, qui ont été structurés en trois piliers par le principe 10 de la Déclaration de Rio, sont reconnus comme étant l'accès à l'information environnementale, la participation du public au processus décisionnel et l'accès à la justice environnementale. La procédure d'évaluation environnementale est un des cadres où ils s'exercent tout particulièrement. Afin de mettre en lumière la force de la démocratie environnementale dans les deux juridictions provinciales, un examen de leur procédure d'évaluation environnementale respective sera effectué suivi d'une analyse comparative pour chacun des piliers. Ce faisant, cette thèse tirera pour chacun des droits analysés des conclusions et proposera différentes solutions afin de renforcer l'exercice des droits procéduraux environnementaux comme la constitutionnalisation du droit à l'information environnementale dans certains contextes, l'identification de certains problèmes de légitimité des institutions effectuant l'évaluation environnementale ainsi que la création de cours de justice spécialisées en environnement.
