Au Canada, le processus de justification des restrictions aux droits et libertés repose sur l’application du principe de proportionnalité. Ce mémoire a pour objectif de mettre en évidence deux tendances observées dans la jurisprudence canadienne concernant l’application du principe de proportionnalité dans les litiges mettant en cause la liberté de religion. Premièrement, les juges effectuent rarement un véritable exercice de pondération entre les intérêts étatiques et religieux. Lorsqu’une mesure gouvernementale entre en conflit avec une pratique religieuse, la première semble se voir systématiquement accorder un poids prépondérant. Deuxièmement, dans les rares cas où les juges se livrent à un réel exercice de pondération, ils accordent généralement peu de poids aux aspects collectifs de la liberté de religion, insistant davantage sur les notions de choix personnel et d’autonomie individuelle. À la lumière de ces deux tendances, ce mémoire soutient que le principe de proportionnalité accorde une protection limitée à la liberté de religion. Les juges protègeront une pratique religieuse dans la mesure où celle-ci revêt une dimension essentiellement individuelle et uniquement s’il est possible de le faire sans compromettre l’objectif qui sous-tend la mesure gouvernementale. L’application du principe de proportionnalité en matière religieuse se traduit ainsi à la fois par une déférence judiciaire envers l’État et par un parti pris pour les traditions qui imaginent l’expérience religieuse comme une quête spirituelle individuelle, subjective et volontaire
