La Première nation des Pekuakamiulnuatsh élabore sa propre constitution qui s’inscrit en dehors du droit canadien, et ce, en parallèle avec la négociation d’un traité moderne avec les gouvernements du Québec et du Canada. L'étude de la démarche constitutionnelle permet de la documenter et de mettre en lumière les stratégies de résistance que l’ordre constitutionnel ilnu exerce afin d'affirmer son existence. Inscrite au cœur d’une stratégie d’affirmation de son droit à l’autodétermination, la démarche constitutionnelle est instiguée sans attendre sa reconnaissance par le droit étatique et vise à revitaliser le constitutionnalisme ilnu. On dénote toutefois que la démarche constitutionnelle contient à la fois des éléments du constitutionnalisme ilnu et canadien. Sans pour autant exclure la démarche de l’ordre constitutionnel ilnu, ces emprunts doivent être contextualisés plus largement dans le cadre d’une période de transition durant laquelle la Première nation doit composer avec les impacts du colonialisme dans l’expression de son ordre constitutionnel. Lorsqu’on analyse plusieurs propositions soumises aux membres lors de la démarche constitutionnelle, on constate que ces emprunts n’empêchent pas pour autant des valeurs et des principes juridiques ilnus d’être revitalisés à travers les nouvelles institutions proposées
