Abstract
La thèse principale soutenue dans ce mémoire avance que le système fiscal canadien devrait adopter une approche fonctionnelle à l'égard de la Règle Générale Anti Évitement (RGAÉ) et, de ce fait, abandonner le principe du Duke of Westminster. Le Chapitre I fournit une revue détaillée de la justification de ce principe, argumentant que ce dernier promeut une idéologie libérale classique. Dans cette perspective, le mémoire s'oppose à la compréhension habituelle du principe qui soutient qu'il serait neutre et apolitique. Le mémoire suggère aussi qu'il faudrait l'abandonner parce qu'il ne s'inscrit pas dans le respect des valeurs de la société canadienne d'aujourd'hui. Le Chapitre II propose une alternative au principe du Duke of Westminster, suggérant une approche fonctionnelle à l'égard de la RGAÉ. Ce chapitre discute aussi de l'enjeu de l'incertitude, argumentant qu'il est possible de développer un test juridique rigoureux et prédictible pour l'application de la section 245. L'approche fonctionnelle se fonde sur la théorie fiscale et sur la revue de la jurisprudence canadienne.
