Depuis plusieurs années, avec l’utilisation de plus en plus répandue des moyens technologiques, la question du consentement est mise de l’avant et discuté dans les différentes sphères de notre société. Le consentement étant intimement lié à l’autodétermination et à la liberté, son importance demeure capitale dans les échanges humains. En 2015, une nouvelle frontière a été franchie avec la décriminalisation de l’aide médicale à mourir. L’arrêt Carter a poussé les gouvernements fédéral et provinciaux à légaliser et légiférer en matière d’aide médicale à mourir. Encore plus récemment, des modifications ont été portées au Code criminel afin de permettre de consentir de manière anticipée à l’aide médicale à mourir. La question que nous nous posons est de savoir si les lois portant sur l’aide médicale à mourir au Canada permettent de consentir au préalable à recevoir ce soin après la perte de la capacité d’exprimer un consentement. Pour répondre à cette question, nous nous pencherons sur la notion du consentement dans différents domaines du droit et nous étudierons les principes fondamentaux qui régissent le consentement à l’aide médicale à mourir. Après avoir effectué cette étude du consentement, nous tenterons d’appliquer certains des principes analysés à ce consentement très particulier. Nous constaterons que le cadre légal actuel ne permet pas l’exercice d’un consentement anticipé et nous proposerons des solutions permettant d’établir un réel consentement anticipé à l’aide médicale à mourir
