Abstract
La délinquance est devenue un phénomène universel qui évolue constamment. Plusieurs facteurs conditionnent aujourd’hui les variations dans la criminalité<a href="#_ftn1" name="_ftnref1" title="">[1]</a>. L’étude du phénomène criminel intéresse désormais plusieurs acteurs de la société notamment sociologues<a href="#_ftn2" name="_ftnref2" title="">[2]</a>, religieux, politiciens, activistes des droits de l’homme etc. Toutefois, si l’apparition des nouvelles formes de délinquance commande l’adoption de règles efficaces, celles-ci doivent tenir compte des droits de l’homme<a href="#_ftn3" name="_ftnref3" title="">[3]</a> et des libertés fondamentales. L’intervention judiciaire d’urgence est souvent remise en cause par l’opinion publique qui s’intéresse désormais au déroulement des procédures judiciaires, surtout lorsque celles-ci mettent en cause des personnalités politiques. Cependant, faut-il reconnaître que la fonction de juger elle-même est antinomique avec la notion d’urgence ? En effet, le règlement des différends par la justice repose sur l’intervention d’un tiers, indépendant et impartial, distant des intérêts des justiciables qui s’inscrit dans un temps nécessaire à la réflexion. Une telle mission nous semble incompatible avec une action judiciaire menée dans l’empressement. De surcroît, l’intervention judiciaire d’urgence peut constituer un facteur éminent de violation du droit au procès équitable. Dès lors, il faut reconnaître que l’urgence est devenue une pratique quotidienne des tribunaux répressifs, soucieux de se conformer aux politiques pénales de traitement en temps réel des agissements criminels.
