La d&eacute;linquance est devenue un ph&eacute;nom&egrave;ne universel qui &eacute;volue constamment. Plusieurs facteurs conditionnent aujourd&rsquo;hui les variations dans la criminalit&eacute;<a href="#_ftn1" name="_ftnref1" title="">[1]</a>. L&rsquo;&eacute;tude du ph&eacute;nom&egrave;ne criminel int&eacute;resse d&eacute;sormais plusieurs acteurs de la soci&eacute;t&eacute; notamment sociologues<a href="#_ftn2" name="_ftnref2" title="">[2]</a>, religieux, politiciens, activistes des droits de l&rsquo;homme etc. Toutefois, si l&rsquo;apparition des nouvelles formes de d&eacute;linquance commande l&rsquo;adoption de r&egrave;gles efficaces, celles-ci doivent tenir compte des droits de l&rsquo;homme<a href="#_ftn3" name="_ftnref3" title="">[3]</a> et des libert&eacute;s fondamentales. L&rsquo;intervention judiciaire d&rsquo;urgence est souvent remise en cause par l&rsquo;opinion publique qui s&rsquo;int&eacute;resse d&eacute;sormais au d&eacute;roulement des proc&eacute;dures judiciaires, surtout lorsque celles-ci mettent en cause des personnalit&eacute;s politiques. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Cependant, faut-il reconna&icirc;tre que la fonction de juger elle-m&ecirc;me est antinomique avec la notion d&rsquo;urgence&nbsp;? En effet, le r&egrave;glement des diff&eacute;rends par la justice repose sur l&rsquo;intervention d&rsquo;un tiers, ind&eacute;pendant et impartial, distant des int&eacute;r&ecirc;ts des justiciables qui s&rsquo;inscrit dans un temps n&eacute;cessaire &agrave; la r&eacute;flexion. Une telle mission nous semble incompatible avec une action judiciaire men&eacute;e dans l&rsquo;empressement. De surcro&icirc;t, l&rsquo;intervention judiciaire d&rsquo;urgence peut constituer un facteur &eacute;minent de violation du droit au proc&egrave;s &eacute;quitable. D&egrave;s lors, il faut reconna&icirc;tre que l&rsquo;urgence est devenue une pratique quotidienne des tribunaux r&eacute;pressifs, soucieux de se conformer aux politiques p&eacute;nales de traitement en temps r&eacute;el des agissements criminels.
