Abstract
Bir hava yolu taşımasının Montreal Konvansiyonu’na tabii olabilmesi için geçerli bir taşıma sözleşmesi bulunması, taşımanın konusu yolcu, yük veya bagaj olması, taşımanın ücret karşılığında gerçekleştirilmesi ve hava yolu taşımasının uluslararası nitelikte olması gereklidir. Montreal Konvansiyonu kapsamında hava yolu taşıyıcısının sorumlu olduğu haller yolcunun ölümü veya yaralanması, bagajın veya yükün zıyaı veya hasar görmesi ve yolcu, yük veya bagajın gecikmesi olup, hava yolu taşıyıcısı bu hallerde ortaya çıkan zararları tazmin etmekle yükümlüdür. Ortaya çıkan zararın maddi veya manevi zarar olması mümkündür. Montreal Konvansiyonu’nun 29. Maddesi uyarınca, hava yolu taşıyıcısının manevi zararlardan sorumluluğu bulunmamaktadır. Farklı mahkeme kararlarında ise yolcunun manevi tazminat talebinde bulunabilmesi, talepte bulunacak yolcunun fiziksel olarak yaralanması şartına bağlanmış ve salt psikolojik zararlara ilişkin manevi tazminat talebinde bulunamayacağı ifade edilmiştir.
