Le séquençage complet du génome humain, une méthode de séquençage dite de nouvelle génération, est un outil de recherche de plus en plus employé dans le domaine de la génétique. L’utilisation accrue de cette technique d’analyse conduit les chercheurs à découvrir des résultats de recherche présentant un certain potentiel clinique et qui, à certaines occasions, peuvent concerner personnellement le participant à la recherche. De plus, le nombre élevé de données générées lors de la recherche peut amener les chercheurs à faire des découvertes dépassant le spectre de recherche initial. Dans le cas où ces résultats auraient une incidence significative sur la santé du participant, le chercheur doit-il les communiquer à ce dernier? Existe-t-il des obligations juridiques à cet égard? Plus précisément, qu’en est-il du médecin-chercheur? Cet essai s’interroge sur les obligations juridiques du médecin-chercheur quant à la communication des résultats de recherche individuels et des découvertes fortuites. Nous analyserons à cet effet la portée du cadre juridique québécois, ainsi que celle des textes normatifs qui ont prépondérance.
