Redefining Canada Health Act Values: A Scoping Review Protocol of Legal and Legislative

Abstract
The Canada Health Act (CHA)1 guides all Canadian jurisdictions on how insured services must be delivered, and failure to meet federally mandated criteria results in the withholding of funding. As such, it provides a framework of what this society values and expects in health care delivery. The complex relationships between levels of government, health care providers, and patients have provided judicial challenges and legislative reviews that have shaped how the Canadian systems apply the core principles of the CHA. In this scoping review, this author’s purpose will be to synthesize legal and legislative decisions that help define how the principles of the CHA are prioritized and identify how jurisdictions can tighten health outcomes and limit jurisdictional disparities in the available health indicators from the Canadian Institute of Health Information (CIHI)2 within the boundaries of the CHA. Using an academic literature search of prominent search engines, this author will map any existing works that include the CHA. This author will conduct a legal decision search through a legal database and catalog decisions by year, principle(s), result(s), and jurisdiction. Legislative literature will be searched through the Parliamentary Library of Canada. The methodology will follow the PRISMA-ScR checklist.3 No ethical concerns are identified, as all the data are publicly available and previously published. The results of the scoping review will be submitted for publishing through a journal with a target audience of health leaders and policymakers, and if feasible through similar target audience conferences.
